SELLER'S LIABILITY

The Seller shall not be liable for any disruptions caused by force majeure of any nature or kind in the event it is unable to fulfill the requested supply within the agreed and expected timeframes set forth in the Terms of Sale. Force majeure events include, but are not limited to, measures enacted by Public Authorities, strikes by its own employees, employees of third-party companies, or employees of couriers and carriers used by the Seller, as well as any other circumstances beyond its control or independent of its will.

Except in cases of willful misconduct or gross negligence, the Seller shall also not be liable for service interruptions or malfunctions related to the use of the Internet beyond its control or that of its subcontractors, nor shall it be held responsible for damages, losses, or costs incurred by the Customer due to the failure to execute the online Sales Contract for reasons not attributable to the Seller, with the Customer being entitled only to a full refund of the price paid and any ancillary charges incurred.

Should the Customer be unable to view part or all of the Website, no liability or responsibility shall be attributed to the Seller, as the Customer is solely responsible for equipping themselves with the necessary devices and software to access the Internet.

The Seller will make every effort to ensure that the Website’s content is up-to-date; however, the absolute absence of errors and/or inaccuracies (such as typographical errors, inaccuracies, or omissions relating to the price, product availability, and product information sheet) cannot be guaranteed. The Seller therefore reserves the right to correct errors, inaccuracies, or omissions even after an Order has been placed and further reserves the right to modify or update the information at any time without prior notice.

 

CHANGES TO THE TERMS OF SALE

The Seller reserves the right to modify the Terms of Sale at any time. The Customer will be subject to the terms of the Terms of Sale in effect at the time the order is placed unless any changes are required by law or competent authorities (in which case, they will also apply to ongoing orders).

If any provision of the Terms of Sale is found to be invalid, void, or for any reason unenforceable, such condition shall not affect the validity and effectiveness of the remaining provisions.

DISPUTE RESOLUTION

Pursuant to Article 12, letter f) of Legislative Decree No. 70 of April 9, 2003, the competent court for disputes related to this contract shall be the court of the Consumer's place of residence or elected domicile, if located within the Italian Republic, as an exclusive jurisdiction under Article 66-bis of the Consumer Code.

The European Commission has established the ODR platform for the out-of-court resolution of disputes concerning contractual obligations arising from online sales or service contracts between a consumer and a professional resident and established in the European Union. The platform is accessible at the following link: https://webgate.ec.europa.eu/odr.
